MYTRUCKMYLOAD TERMS OF SERVICE AGREEMENT

This Terms of Service Agreement ("Agreement") is made between Mytruckmyload LLC ("Mytruckmyload," "we," "us," or "our") and any user ("User," "Broker," "Owner-Operator," or "you") accessing or using our platform. By using Mytruckmyload, you acknowledge that you have read, understood, and agreed to this Agreement.


1. NO LIABILITY DISCLAIMER
Mytruckmyload is a neutral platform that connects brokers and owner-operators for load postings. We do not verify, guarantee, or assume any responsibility for the accuracy of information provided by users. Mytruckmyload is not a party to any transactions or agreements between brokers and owner-operators.

1.1. No Responsibility for Transactions: Mytruckmyload does not assume responsibility for any disputes, losses, damages, or claims arising from interactions, contracts, or transactions conducted through our platform.

1.2. Accuracy of Information: Users are solely responsible for ensuring that all information they provide on Mytruckmyload is accurate, complete, and truthful. Any false, misleading, or inaccurate information is the sole responsibility of the user providing it.


2. USER RESPONSIBILITIES
2.1. Compliance with Laws: Users agree to comply with all applicable federal, state, and local laws when using Mytruckmyload.

2.2. Honest and Accurate Listings: Brokers and owner-operators must ensure that all load postings, offers, and agreements made through Mytruckmyload are accurate and reflect truthful information.

2.3. Indemnification: Users agree to indemnify and hold Mytruckmyload harmless from any claims, damages, losses, liabilities, costs, or expenses arising from their use of the platform, including but not limited to misrepresentation, breach of contract, or legal violations.

2.4. Insurance Requirements: All trucks must have valid insurance, and cargo insurance is mandatory for all shipments.

2.5. Broker and Carrier Requirements:
- Double brokering is strictly prohibited.
- Brokers must have a valid MC (Motor Carrier) number.
- Owner-operators must have both DOT (Department of Transportation) and MC numbers.

2.6. Load Transport Compliance:
- The assigned truck must be the one transporting the booked load.
- Driver information must remain unchanged; the driver assigned to a specific load must complete the transport without substitution.


3. LIMITATION OF LIABILITY
MYTRUCKMYLOAD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM THE USE OF THE PLATFORM. THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES RESULTING FROM TRANSACTIONS, DISPUTES, DATA LOSS, OR BUSINESS INTERRUPTION.


4. ACCOUNT SUSPENSION & TERMINATION
Mytruckmyload reserves the right to suspend or terminate any account that violates our terms, provides false information, engages in fraudulent activities, or fails to comply with applicable laws.


5. MODIFICATIONS TO AGREEMENT
Mytruckmyload reserves the right to modify this Agreement at any time. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of the revised terms.


6. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of [Insert State], without regard to conflict of law principles.
